Drink Driving is an offence committed under Section 5(1)(a) of the Road Traffic Act 1988. It was first introduced as an offence in 1925 (as part of the Criminal Justice Act):
it is an offence to be drunk when in control of any mechanically-propelled vehicle on a highway or any other public place. The penalty was a maximum of £50 and/or imprisonment for up to four months, as well as a disqualification from holding a licence for at least one year.
In 1965 Parliament introduced a new legal limit of 80mg of alcohol per 100ml of blood. You may be surprised to hear that the legal limit remains the same since then.
